Not only did he disregard these warnings, but he also neglected to pay the required vehicular access fee, compounding his legal troubles.
Video footage from the scene depicted Brzuszkiewicz maneuvering his truck through the shallow waters for an extended duration, even attempting a risky donut maneuver amidst the waves. His actions prompted concern from three New Smyrna Beach lifeguards, who approached him under the assumption of a potential medical emergency.
However, upon the arrival of law enforcement, Brzuszkiewicz did not attempt to conceal his intentions, admitting outright that he desired to drive on the beach. This confession, captured in the affidavit obtained by FOX 35, revealed his ignorance of the closure’s rationale, citing a lack of awareness regarding the adverse weather conditions.
Despite deputies’ explanations regarding the closure and the associated legal ramifications, Brzuszkiewicz’s nonchalant response of “It’s not my fault the truck don’t surf” underscored his disregard for the rules. Consequently, he was promptly arrested and transported to the Volusia County Branch Jail, where he faced charges under Volusia County Ordinance 20-174 for failing to pay the vehicular access fee.
