Brazilian national arrested on several charges, released, arrested again, then captured by ERO Boston

Enforcement and Removal Activities of U.S. Immigration and Customs Enforcement in Boston Anderson De Sousa Almedia, 43, was taken into custody by Boston on November 30. He was detained by the Everett Police Department on July 6 and charged with assault and battery, assault with a deadly weapon, and assault and violence on a family member or household member. On July 8, the Malden District Court freed De Sousa from detention, disregarding the ICE simmigration detainer.

While on pre-trial probation, De Sousa was arrested by the Malden Police Department on November 29 for reportedly threatening to kill and abusing a family member or household member.

According to Patricia H. Hyde, acting Field Office Director for ERO Boston, De Sousa was freed by the Malden District Court in July, the day after ICE filed an immigration detainer against him. The Malden Police Department arrested him on additional charges of assault and battery on a family or household member, indecent assault and battery on a person over 14, and threats to commit murder while he was out of custody and prior to his criminal court date of December 2. Instead of being in a position where he is now accused of committing more offenses, he would have been in ICE custody if the court had granted our initial detainer request. We appreciate Malden police alerting us before letting him go again.

De Sousa, a Brazilian national, was first freed on recognizance from U.S. Border Patrol detention after entering the country illegally near Lukeville, Arizona, on July 29, 2023. In order to request that local law enforcement transfer De Sousa to federal custody in a secure setting, ICE submitted two immigration detainers on July 7 and November 30. Before releasing him, the Malden Police Department informed ICE and honored his detainer.

De Sousa will continue to be held by ICE while he is involved in his immigration case.
