After reportedly beating his 2-year-old daughter for several days, forcing her to sleep in a “cubby,” and waiting five hours to contact 911 after discovering her unconscious, a Nevada father is in incarcerated.
According to a news release from the Washoe County Sheriff’s Office, Nicholas Loving, 35, is charged with child abuse in connection with Izabella Loving’s death at their Cold Springs, Utah, residence, which is about 20 miles north-west of Reno.
Loving is incarcerated in the Washoe County Jail on a $10 million bond, according to records.
According to deputies, they arrived at the Loving residence just before seven in the morning on April 3. They discovered Izabella unconscious when they got there.
On the spot, paramedics declared her dead. According to deputies, a follow-up investigation found “significant signs of physical abuse inflicted” upon Izabella.
The accusations are further detailed in a probable cause arrest affidavit acquired by the Reno Gazette Journal and local station KOLO. In the days before her death, Loving allegedly kicked their daughter in the genitalia and dragged her across the room by her sweatshirt, according to Izabella’s mother, who has not been charged with any crimes.
According to her mother, Izabella had been throwing up mucous and blood for around ten days. According to the affidavit, the mother claimed that Izabella’s body temperature was 96 or 97 degrees on the night in issue. She then gave Izabella a bath, and she “seemed fine.”
After that, Loving locked her in a little box and put her to bed.
“Nicholas admitted that they would sometimes keep Izabella in a small make-shift cubby (located on scene by the detectives, approximately 5′ by 5′) in the girls room,” according to the affidavit. “He admitted having locked her inside on one occasion but that [the mother] mostly put Izabella inside of it.”
Around midnight, one of their other kids woke up the parents to report that they had witnessed Izabella throwing up. When Loving opened the box two hours later, the girl was not responding.
However, Loving apparently attempted to plot his next course of action to save himself rather than dialing 911. According to reports, the mother informed investigators that her husband would not allow her to dial 911.
After burying Izabella’s body in the backyard, Loving allegedly advised the family—including their other children, who are aged four, seven, and ten—to “run” for their lives. Then he allegedly devised another scheme.
“Ultimately, they decided to remove Izabella from the cubby, drag her and her bed across the room and stage it there,” according to the complaint. “Go with the story of them finding her at around 7 a.m. and they came up with explanations of her injuries, being that she fell multiple times or was hit with toys.”
According to the affidavit, the defendant reportedly attempted to attribute some of the girl’s injuries to his other children, claiming that they had struck her with a plastic bat.
According to police reports, Izabella had ten different facial injuries, including a black eye and a cut above the other eye. Investigators also saw that she had scratches and bruises on her hips, pelvis, biceps, and genitalia.
The cause and manner of death are currently being investigated by medical examiners. He and his spouse may face more charges in the future. His wife would be in prison with her husband if she had a say.
“I should go to jail for not helping Izabella, Nick should go to jail for killing her,” she reportedly stated.
