Kelly’s claim centers on the packaging of Reese’s Peanut Butter Pumpkins, which she purchased at Aldi for $4.49. Expecting the product to feature the cute carvings of a pumpkin’s mouth and eyes as depicted on the label, Kelly was disappointed to find the actual chocolate devoid of such artistic details.
The lawsuit argues that this discrepancy between packaging and product constitutes misleading advertising, leading consumers to purchase based on false representations. This legal action encompasses a range of Reese’s products, including shapes like ghosts, bats, footballs, snowmen, and bells.
Significantly, Kelly pointed out that the packaging of these products was not always misleading. She noted that until about two or three years ago, the actual products matched their packaging, featuring the depicted faces and designs.
