The hearing, scheduled before Judge Aileen Cannon, will focus on two key motions filed by Trump’s lawyers.
The case revolves around allegations that Trump unlawfully retained classified government records during the presidential transition period, along with accusations of obstruction of investigations. Despite facing 32 counts, Trump and his aides have maintained their innocence, pleading not guilty.
In their defense, Trump’s attorneys argue that as president, he had the authority to determine the classification of documents and that the Presidential Records Act shielded him from prosecution in this matter. Furthermore, Trump’s team contends that there are unresolved legal questions regarding the Espionage Act, under which Trump has been charged. They argue that the ambiguity of the law violates constitutional standards of clarity. However, Smith, the special counsel, rebuts this claim, asserting that the statute’s prohibitions are clear-cut.
