In a detailed court filing, attorneys Todd Blanche and Christopher Kise claim that Special Counsel Jack Smith’s office is not complying with standard discovery obligations, potentially withholding crucial records.
Trump’s defense accuses Smith’s office of intentionally avoiding the release of exculpatory evidence. They argue that this evidence could potentially originate from senior officials in the White House, Department of Justice (DOJ), and FBI. These agencies, along with others like the National Archives and Records Administration (NARA) and the Office of the Director of National Intelligence (ODNI), are implicated in what Trump’s lawyers describe as a “flawed investigation.”
The motion, filed by Trump’s legal team, specifically requests U.S. District Judge Aileen Cannon to order federal prosecutors to disclose a wide range of information crucial for the former president’s defense. This includes broadening the definition of the “prosecution team” to encompass various intelligence community agencies involved in the investigation, such as the CIA, NSA, and others.
Due to the sensitive nature of the case, which revolves around classified government documents, much of the evidence remains concealed from public view. The Trump filing contains numerous redactions and references to proceedings not yet public. Legal experts, including former U.S. Attorney Joyce Vance, suggest awaiting a response from Jack Smith’s office, anticipating it to be significant given the defense’s demands.
